Penta says Lex Haščák is unconstitutional
A draft bill, called Lex Haščák and submitted by a PS/Spolu coalition, aiming to ban cross-ownership in the healthcare sector, is in violation of the Slovak Constitution and constitutes disproportionate and unjustified interference with property rights, argues Penta. The bill is named after Penta partner Jaroslav Haščák. Penta based its claim on legal standpoints from Radoslav Procházka, Marek Benedik and Dentons, a law firm. It complains that the bill would lead to expropriation of Penta's assets without adequate compensation. It maintains that there is no evidence of Penta abusing its cross-ownership of health insurer, hospitals, and clinics.
